General Information
This ‘Terms and Conditions’ is published in accordance with the provisions of Rule 3 of the Information Technology (Intermediaries Guidelines) Rules, 2011. This “user agreement” can be changed or updated anytime without giving you any prior notice. Any such changes will not apply to any disputes between you and the Company, i.e. Milkano Agro India Pvt. Ltd. or www.milkanoagro.com.
Terms of Use
www.milkanoagro.com (“Website and Application”) is an online e-Commerce platform to supply FnV (fruit and vegetables) and other agro based FMCG products of Milkano Agro India Pvt. Ltd. and of other brands/companies having its Corporate office at 5/15A, Lane no 5, Mundka, New Delhi-110041. Milkano Agro India Private Limited or its Director is the authorised owner of MILKANO (The Brand) and website www.milkanoagro.com (The Site), which will be governed by the terms and conditions, privacy policies, rules of Milkano (“Terms”) posted on the website and application from time to time. Such terms will be applicable to all which includes Registered and Guest users.
Please read our Terms and Conditions carefully before using the Website and application as your use of the Website and application is subject to your acceptance of and compliance with the Terms. If you do not agree or are not willing to be bound by the terms and conditions of this User Agreement and any Rules, Terms and Conditions and Policies of Milkano Agro India Pvt. Ltd. or www.milkanoagro.com, please do not click on the "I Accept" button or check box and on the "Continue" button or "Pay Now" button and do not subscribe or seek to obtain access to or otherwise use the Website and application for any purpose.
By subscribing to or using the website and application or any of our services through the Website and application you agree that you have read, understood and are bound by the Terms, Policies, directions of Milkano Agro India Pvt. Ltd. www.milkanoagro.com regardless of how you subscribe to or use the Website and application. This Agreement comes into effect upon your "Acceptance" of these terms and conditions ("Terms") however Milkano Agro India Pvt. Ltd. or www.milkanoagro.com at its sole discretion reserves its right not to accept a user from registering on the Website and application without assigning any reason thereof.
Price and Payment Policy
Price of the products, daily offers, banner, deal posted on MILKANO or www.milkanoagro.com are subject to change anytime, without any prior notice to the customer. We make conscious efforts in terms of providing you the best price on our online platform. Some food products which includes milk, juice and beverages items do change on regular basis. Products listed on MILKANO or www.milkanoagro.com will be sold in INR at MRP mentioned, inclusive of all taxes or at discounted price with taxes, unless otherwise specified.
Milkano Agro India Pvt. Ltd. and www.milkanoagro.com take extreme precautions while displaying or giving best price to its customers. But there might be some instances of mispricing of items on our website and application due to any technical errors or mistake while typing. If the food item/product’s price is lower than our set price, we will charge the lower amount and send you the item. If a food item/product price is higher than our set price, you may return the item/product at the time of delivery. We will cancel the order and refund you the amount you paid, as per the refund policy of our company, without giving any compensation to you.
Payment Policy
Milkano Agro India Pvt. Ltd. provide you multiple payment options both online and offline. However, such mode can be discontinued anytime without giving you any prior notice.

Offline Payment Mode
Cash on Delivery (CoD):
Customers can make the payment in cash at the time of delivery against the receipt of the food item/products at the delivery address mentioned in the order. Under CoD option, maximum order value will be INR 2,000/-. However, Milkano Agro India Pvt. Ltd. can change, alter or revise the limit without any further notice to the customers. There may be an instances where payment is attempted but remains unsuccessful, you shall make the payment in cash for that particular order. However, our company will not be responsible for any failed attempts/transactions where you get the confirmation message from bank. In such cases, amount will be reversed in the same account. Milkano Agro India Pvt. Ltd. will not be responsible for any failed attempts due to any network or technical reasons. Our company, upon written request from customer, may give a written confirmation to the customer regarding non-receipt of payment so that the customer may approach their bank to get the remedy.
Card Acceptance
Milkano Agro India Pvt. Ltd. baring card issued by few banks, accept payment of major credit and debit card issued in India. Accepting or declining the card or its type is the sole discretion of Milkano Agro India Pvt. Ltd. Our company don’t accept international credit or debit card.
Order
Customer can raise order using the web and mobile application of www.milkanoagro.com by selecting any payment mode of their choice. If buyer is willing to make the payment offline, they need to pay the invoice payment amount in cash at the time of delivery at the delivery location specified at the time of raising order. As soon as we receive the order, we will process the same for delivery at the delivery address with date, time and confirmation by us. If customer can raise order online, and mention to collect order from store, he will have to come to collect the order from store only. Milkano Agro India Pvt. Ltd. or www.milkanoagro.com will have no responsibility to deliver the items to the customer.
Payment
Milkano Agro India Pvt. Ltd. or www.milkanoagro.com will not bear any liability whatsoever in respect of any loss, or damage arising directly or indirectly due to the following reasons:
  1. 4.1. Lack of authorization for any transactions
  2. 4.2. Exceeding the present limit offered/agreed by you and your issuing bank
  3. 4.3. Any payment issues arising out of the transactions or Decline of transactions for any reasons.

Milkano Agro India Pvt. Ltd. or www.milkanoagro.com reserves its right to change the price of its product without any prior notice to the customers. Price stated at the time of raising an order will remain valid/applicable at the time of delivery.
While raising order you confirm that the card used for the transactions is of yours and you are authorise to use it for the said purpose. You further undertake to provide correct and valid details while transactions. In case of any failed transactions due to the refusal by your issuer bank, we will not be liable for any delay, failed transactions or non-delivery etc. To ensure safety of our customers, we may ask you to provide copy of photo identity proof as acceptable by Milkano Agro India Pvt. Ltd.to establish your ownership. Milkano Agro India Pvt. Ltd. reserve the right to restrict/limit the number of transactions for the individual.
Indemnification:
You agree to indemnify, defend and hold harmless us and affiliates including employees, directors, officers, agents and their successors and assigns from and against any and all losses, liabilities, claims, damages, costs and expenses (including legal fees and disbursements in connection therewith and interest chargeable thereon) asserted against or incurred by us arising out of your actions or inactions or result from your breach of the Terms and Conditions herein or any document incorporated by reference/hyperlink or infringement of intellectual property rights or your violation of any law, rules or regulations or the rights of any third party.
You hereby expressly release Milkano Agro India Pvt. Ltd. or www.milkanoagro.com and/or its affiliates and/or any of its officers and representatives from any cost, damage, liability or other consequence of any of the actions/inactions of the Manufacturers/Brand owners of the Products purchased through the website and application and specifically waiver any claims or demands that you may have in this behalf under any statute, contract or otherwise. This clause shall survive the expiry or termination of this Agreement.
Termination Policy:
This user agreement shall be effective form the date and time of your acceptance of the Terms of the Website and application and remain in force unless and until terminated by either of us. You may terminate this Agreement at any time, provided that you discontinue any further use of this Site. Milkano Agro India Pvt. Ltd. may terminate this User Agreement at any time and may do so immediately without notice, and accordingly deny you access to the Site, Such termination will be without any liability to us.
